Terms of Service

1. Purpose of the Portal

The Portal is provided to allow educational institutions, organizations, and individuals to submit information for the purpose of determining eligibility for discounts or special pricing on DevCore services.

Submission of an application does not guarantee approval, eligibility, or receipt of any particular discount.

DevCore reserves the right to determine eligibility based on the information and documentation provided and any applicable requirements of the relevant discount program.

2. Eligibility

You may use the Portal only if:

• You are legally capable of entering into these Terms under applicable law.
• The information you provide is accurate and truthful.
• You have the authority to submit information on behalf of an institution or organization, where applicable.
• You use the Portal for a legitimate verification purpose.

If you submit information on behalf of an institution or organization, you represent that you are authorized to provide that information for verification purposes.

3. Accuracy of Information

You agree to provide complete, accurate, and current information.

You must not:

• Provide false or misleading information.
• Impersonate another individual or organization.
• Submit forged, altered, or fraudulent documentation.
• Misrepresent your educational, professional, or organizational affiliation.
• Attempt to obtain a discount for which you do not qualify.
• Submit information belonging to another person without appropriate authorization.

DevCore may reject or suspend an application where information appears inaccurate, incomplete, fraudulent, or unverifiable.

4. Verification Process

DevCore may review information submitted through the Portal to determine eligibility.

We may:

• Request additional information.
• Contact an institution or organization to verify an applicant's affiliation.
• Review publicly available information where reasonably necessary for verification.
• Reject an application if eligibility cannot be sufficiently established.
• Reassess eligibility if circumstances or information change.

Verification decisions are made at DevCore's discretion, subject to applicable law.

5. Discounts and Special Pricing

Any discount, promotional pricing, or special pricing offered through the verification program:

• Is subject to eligibility requirements.
• May be changed or discontinued by DevCore.
• May be subject to additional terms.
• May not be transferable unless expressly permitted.
• May not be combined with other promotions unless expressly permitted.
• May be revoked if obtained through fraud, misrepresentation, or unauthorized use.

Verification approval does not necessarily guarantee that a discount will remain available indefinitely.

6. Prohibited Activities

You may not use the Portal to:

• Submit fraudulent or deceptive information.
• Attempt to bypass verification requirements.
• Gain unauthorized access to the Portal or its underlying systems.
• Interfere with the operation or security of the Portal.
• Introduce malicious code, malware, or other harmful material.
• Scrape, copy, or systematically extract Portal data without authorization.
• Attempt to access another applicant's information.
• Use information obtained through the Portal for unauthorized purposes.
• Circumvent technical, security, or access controls.

DevCore may suspend or terminate access where we reasonably believe these Terms have been violated.

7. Confidentiality

Information submitted through the Portal may be confidential or personal.

You agree not to submit confidential information belonging to another person or organization unless you have the necessary authority to do so.

DevCore will handle submitted information in accordance with our Privacy Policy and applicable law.

8. Third-Party Services

The Portal may rely on third-party services for functions including forms, data collection, database infrastructure, hosting, communications, security, and other technical services.

These third-party services may process or store information submitted through the Portal on DevCore's behalf.

Our database and hosting infrastructure for the Portal is located in Frankfurt, Germany.

Your use of the Portal may therefore involve the processing or transmission of information through third-party infrastructure necessary to provide the Portal.

9. Intellectual Property

The Portal, including its design, text, branding, software, graphics, and other content, is owned by or licensed to DevCore unless otherwise stated.

You may use the Portal only for its intended purpose.

Nothing in these Terms grants you ownership of DevCore's intellectual property or any license beyond what is reasonably necessary to use the Portal.

10. Availability

We aim to keep the Portal available and functioning reliably, but we do not guarantee uninterrupted or error-free operation.

The Portal may occasionally be unavailable because of maintenance, upgrades, security measures, technical failures, third-party service interruptions, or circumstances beyond our reasonable control.

11. No Guarantee of Verification or Discount

Submitting an application does not guarantee:

• Verification approval.
• Eligibility for a discount.
• A particular discount amount.
• Continued eligibility.
• A specific processing time.

DevCore may request additional information or decline an application where eligibility cannot be established.

12. Disclaimer

To the maximum extent permitted by applicable law, the Portal is provided on an “as available” and “as is” basis.

DevCore does not guarantee that the Portal will always be available, secure, accurate, complete, or free from errors or interruptions.

Nothing in these Terms excludes or limits rights or protections that cannot legally be excluded or limited under applicable law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, DevCore will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or relating to your use of the Portal.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including liability that cannot legally be excluded or limited.

14. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, damages, and reasonable expenses arising from your intentional misuse of the Portal, fraudulent submissions, violation of these Terms, or infringement of another person's rights.

This provision does not apply to the extent that applicable law prohibits such an obligation.

15. Suspension and Termination

DevCore may suspend or terminate your access to the Portal if:

• You violate these Terms.
• You provide fraudulent or misleading information.
• You attempt to abuse the verification program.
• Your use creates a security or legal risk.
• We discontinue or substantially modify the verification program.

Termination does not affect provisions that by their nature should continue after termination.

16. Privacy

Your use of the Portal is also governed by the DevCore Enterprise Privacy Policy, which explains how personal and confidential information submitted through the Portal is collected, used, stored, and protected.

17. Changes to These Terms

We may modify these Terms from time to time.

Updated Terms will be posted through the Portal or otherwise made available to users, and the effective date will be updated accordingly.

Where required by applicable law, we will provide additional notice of material changes.

18. Governing Law

These Terms will be governed by the laws applicable to DevCore Enterprise and the relevant jurisdiction, without regard to conflict-of-law principles, unless applicable mandatory law provides otherwise.

Any disputes will be handled by the courts or other competent authorities having jurisdiction under applicable law.

19. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permitted.

The remaining provisions will continue in effect.

20. Entire Agreement

These Terms and the DevCore Enterprise Privacy Policy constitute the principal terms governing your use of the Portal and supersede prior statements concerning the same subject matter, except where additional terms are expressly provided for a particular DevCore service or discount program.
